Despite all their efforts, Steve Adler and Greg Casar were handed another defeat by the Texas Supreme Court in their decision to block enforcement of Austin, Travis county restaurant restrictions. The momentary block to Abbott’s order by local Progressive activist judge Amy Meachum lasted only a few hours before the Texas Supreme Court overruled her attempts to back Casar and Adler’s agenda to keep Austin shut down.

Without hearing oral argument, and having considered “Defendants Travis County and City of Austin’s Joint Response in Opposition to Plaintiff’s Application for Temporary Injunction,” we conditionally grant the petition for writ of mandamus and direct the court of appeals to issue relief under Texas Rule of Appellate Procedure 29.3, instanter, enjoining enforcement of Travis County’s County Judge Order 2020-24 and the Mayor of the City of Austin’s Order No. 20201229-24 pending final resolution of the appeal. Our writ will issue only if the court of appeals does not comply.
Data clearly shows restaurants are NOT responsible for the spread of Covid and they shouldn’t be political scapegoats. There is no reason every small business cannot be much safer than the masses packing the local WalMarts.
Watch for Austin to enter new phase of rampant testing to try to spike the case numbers enough to fight back against Greg Abbott. This deep seeded war goes way back and there is no sign that either side is going to back down. More tests = more positives for the virus.
